TERMS AND CONDITIONS

1. Introduction

These Terms & Conditions (“Terms”) govern the use of our e-commerce platform eCom Gresham (“Website”), operated by Gresham’s Eastern (Pvt.) Ltd. (“Company”), and apply to the purchase of industrial parts, equipment, and related products offered by the Company.

By accessing our Website or placing an order, you agree to comply with these Terms. All purchases through eCom Gresham are legally contracted with Gresham’s Eastern (Pvt.) Ltd., the registered operating entity.

2. Eligibility

2.1 Our products are intended strictly for industrial, commercial, and business use only in all countries other than those where sanctions apply.

2.2 By placing an order, you confirm that you are a registered business entity or an authorized representative acting on behalf of such entity.

3. Orders & Acceptance

3.1 All orders are subject to review and written acceptance by the Company.

3.2 A contract is only formed once an Order Confirmation / Proforma Invoice is issued by the Company.

3.3 The Company reserves the right to reject or cancel any order due to incorrect pricing, stock unavailability, or compliance restrictions.

4. Pricing & Payment

4.1 All prices are quoted in USD and/or PKR, unless otherwise stated.

4.2 Accepted payment methods: Telegraphic Transfer (T.T.), bank transfer, Letter of Credit (L/C), or other approved payment arrangements.

4.3 All bank charges, remittance fees, and L/C issuance costs are borne by the Buyer unless otherwise agreed in writing.

4.4 Any taxes, duties, or import/export charges (if applicable) will be paid by the Buyer in addition to the item price shown on our Website or Proforma Invoice.

5. Product Specifications

5.1 Product descriptions, technical data, and images are provided for guidance only.

5.2 It is the Buyer’s responsibility to verify compatibility and suitability prior to purchase.

6. Warranty & Liability

6.1 The Company, with 54 years of experience in engineering goods, endorses only those manufacturers whose products it has satisfactorily used.

6.2 Standard warranty is two (2) years from shipment, provided installation is in accordance with our guidelines and certified protocols.

6.3 Manufacturer’s warranties (if any) apply subject to their terms.

6.4 Limitation of Liability: The Company’s liability shall in no case exceed the purchase price of the product supplied. Indirect, consequential, or production losses are excluded.

6.5 Force Majeure: Neither party shall be held liable for delays or failures caused by events beyond reasonable control, including but not limited to natural disasters, pandemics, strikes, port closures, or government restrictions.

7. Governing Law & Dispute Resolution

7.1 These Terms are governed by the laws of Pakistan.

7.2 Any disputes shall fall under the exclusive jurisdiction of the courts in Pakistan and may be referred to the National Centre for Dispute Resolution (NCDR).

7.3 Subject to mutual agreement, disputes may also be resolved through arbitration in accordance with the Arbitration Act of Pakistan.
